Misfiled Prescriptions

The unintentional misfilling of a prescription by a pharmacist can often times have tragic outcomes for you or your family members. Pharmacists have the legal obligation to insure that the medication given to a patient is what is prescribed by the physician. This is the pharmacist's most important job. When the pharmacist fails to fulfill this duty, the pharmacist and their employer are legally responsible for the consequences.

Misfilled prescriptions are far too common. A steady stream of horror stories have been reported in the news. Studies indicate that the percentage of misfilled prescriptions in the United Stated may be as high as 2 or 3 percent of the prescriptions filled! Most of these misfilled prescriptions result in no obvious harm to the patient. However, a significant percentage can result in serious injury or harm.

The most common issue in the ensuing litigation is often the communication between physician and pharmacy: Was the prescription legible? What was said in any telephone communications between the doctor and the pharmacy? Should the pharmacy have known that the prescription was inappropriate for the patient?
